Update 11 on Transport Legislation: National Road Traffic Amendment Bill, 6 December 2024
The President signed the National Road Traffic Amendment Bill, 2020 into law on 5 December 2024.
The Act addresses a wide range of issues relating to road traffic. Please note the amendments are not in force yet. The President must public a proclamation to implement the amendments. Several of the provisions also require regulations that have not been finalised yet.
Please see the NRTA Bill under Downloads – Government Gazettes on our website for more information. The term “prescribed” indicates the need for regulations (highlighted in yellow).
Among many other provisions the amendments address –
• Adds requirements for the suspension and cancellation of the registration of driving license examiners, vehicle examiners and traffic officers.
• Driving schools will have to be registered and graded to continue training drivers.
• Provision is made for reserve officers.
• Additional offences relating to fraudulent learner and driving licence testing are added.
• Microdot fitment and use are controlled by the legislation.
• Legislation controlling manufacturers, importers, body builders and builders of motor vehicles are also amended to heighten control measures.
• The number plate manufacturing and embossing industry will be regulated more extensively than the current legislation.
• Incident management after accidents will become compulsory.
• Drivers of emergency vehicles will have to ensure they are seen by other drivers before entering traffic light and stop-sign controlled intersections
