Question:
Our drivers are still being pulled over and fined for transporting dangerous good when they transport less than 1000L of diesel in jerry cans.
I have attached an extract of Chapter 8 of the National Road Traffic Act but we need to also print and laminate SANS 10231 and/or Regulation 276 of the National Road Traffic Regulations – assuming of course that we are compliant. If we are not, we will have to take the necessary actions to ensure we are indeed compliant.
Articles and the actual SANS10231 are a bit vague and do not go into much detail in accordance with law and how we can legally protect ourselves from future fines
After an intensive search of the same, the only passage which I have come across is SANS10231 ” SANS 10231: This code of practice prescribed the operation rules and procedures for transporting Dangerous Goods and Hazardous Materials. It also includes the prescribed responsibilities of the owner/operator of the dangerous goods vehicle. It outlines the information required and who will have to supply information for the safe conveyance of dangerous goods. The requirements for the drafting and formulating of an operational agreement are also specified. This code also requires the owner/operator or vehicle to be registered as a dangerous goods carrier. It is also prescribed that the owner-operator has available adequate insurance cover for civil liability as well as pollution and environmental rehabilitation cover in the event of an incident.”
Which does not go into actual details.
We don’t want our drivers to lose their licences if AARTO’s demerit system is implemented next year.

Answer:
The 1000 l exemption is only if the diesel is transported in a tank. You may only carry 60 l of fuel in a vehicle in portable containers.
